The Community is an online community established by us to undertake research, consultation and engagement.
You can use the Community as a forum to share ideas and give your opinion on services. Through the Community You can:
The Community is open to people who live, work or spend their free time in Tameside.
You must be aged 16 or over to register for and join the Community.
The Community is an optional service; there is no obligation on you to register for, or participate in, the Community
When You sign up to the Community You are asked to create a screen name. We advise that You do not use Your full name or email address as a screen name.
Your use of the Community is password protected and You are responsible for maintaining the security of that password. You should change Your password immediately if you suspect any unauthorised use has been made of it. You should also let us know at firstname.lastname@example.org if You know of, or suspect there has been any unauthorised use of Your account as You are responsible for all activities that take place using Your account.
We reserve the right to suspend access to or withdraw or amend the Community (or any part of it) at any time without notice. We will not be liable if for any reasons the Community is unavailable at any time or for any period.
The Community has been developed to work across a broad range of desktop, tablet and mobile devices; however, some may be lower grade than others and therefore will not necessarily provide the same user experience. The platform is compatible with IE11 or higher, chrome, firefox, opera and safari.
Membership of the Community does not entitle You to participate in a minimum number of surveys.
When You register as a member of the Community, we will ask You for some basic personal information about You (such as your email address, postcode, year of birth and gender). You may also be asked to provide other personal details from time to time such as your income band, occupation, education and area of interest (collectively "Personal Data"). By participating in the Community, You consent to us using your Personal Data in accordance with these Conditions of Use.
We will hold Your Personal Data in accordance with the Data Protection Act 1998.
The Personal Data will be stored and used:
When You complete a survey, Your answers will be anonymised and collected together with the answers given by other users. These results then may be published or disclosed to third parties. However, we will ensure that no data which could identify you will be released.
We will never sell Your Personal Data.
You must ensure that all Your Personal Data (including your email address) are kept up to date. If You want to change any Personal Data that we hold, You may request that inaccurate data about You is corrected, blocked or deleted by contacting us at email@example.com.
All surveys will be conducted in accordance with MRS guidelines (see http://www.mrs.org.uk/standards/guidelines).
The Community will be regularly updated and the content available on it may change at any time. Content will generally be available ongoing from the date on which it is posted or last modified.
We are under no obligation to update any content and therefore it is possible that any of the content on the Community may be out of date at any given time.
You must not allow anyone other than yourself to access the Community from Your account.
We have no control (and take no responsibility) over how the content that You make available on the Community will be used by other users. You should only upload relevant content, ideas and opinions that you are comfortable with others using and which You have the right to share with third parties.
Any content uploaded to the Community open forums will be deemed non-confidential but you must not misuse any content that is available on The Community.
You must not knowingly or intentionally introduce viruses or other malicious or technologically harmful software onto or using the Community or otherwise make efforts to interfere with, disrupt or impair the functionality of the Community. You must not attempt to gain unauthorised access to the Community by any means.
Whenever You upload content to the Community or make contact with other users, You must comply with these acceptable use standards.
You are responsible for Your own actions and for all content that You upload to the Community. You have a responsibility to treat the Community, and all of the content contained on it, in a respectful manner.
You must not use the Community to do anything (e.g. upload or share any content) that may be considered actions or promotions of the following:
You must not upload or share on the Community sensitive information (e.g. information about religious or similar beliefs, racial or ethnic origin, health or criminal offences) about You or others.
You should not upload to the Community content about others.
We reserve the right to remove content and/or de-register Your account without notice if you fail to abide by the acceptable behaviour clauses set out above. Our decision is final in these matters.
We own or license all of the intellectual property rights in the Community and in the content that we (and our administrators) publish on it. All content is protected by intellectual property laws, which You must observe. You hereby grant to us an exclusive, royalty-free and irrevocable licence to use Your content including text and images, which you submit in surveys or through feedback or comments, including the right to copy, publish, modify and transfer such materials to others.
We do not warrant or accept any liability or responsibility to anyone for the adequacy, accuracy, legality or completeness of any content available on the Community. We do not endorse or take responsibility for any content uploaded by You or any other user or any use made of it.
The Community and all content available on it are provided on an 'as is' and 'as available' basis. All content is provided without any guarantees, conditions or warranties (express or implied), and in particular, we do not provide any warranty that the Community or any content will be:
We may, but is under no obligation, to monitor The Community and any content made available on it. User generated content may therefore appear on The Community without prior moderation.
If You wish to report any instances of misuse or inappropriate use of The Community including any information uploaded to The Community that You consider offensive, inappropriate or out of date You may do this by contacting the The Community administrators at firstname.lastname@example.org.
If The Community administrators receive two or more notices that You have misused The Community or that Your content is inappropriate, Your access to The Community will be automatically blocked and You will be referred to The Community administrators.
You must reside permanently in the UK, unless otherwise stated by us when joining the Community.
You will provide a personal email address and a confidential password when registering for the Community. You must not disclose Your password to anyone else and you must keep it safe. We will not be liable for any unauthorised use of your account.
You may only have one membership of the Community.
If we identify a duplicate account for the same person, we may de-register one of the accounts without notice.
You agree to respond truthfully and carefully to all questions in the surveys that you participate in, and to always provide accurate information about Your sex, age and any other background information that is requested.
Where The Community contains links to other sites and resources provided by unrelated third parties, these links are provided for Your information only. We may not have control over the content of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from Your use of them.
If You have any questions or comments about the Community or wish to report any inappropriate content, please contact an administrator at email@example.com.
These Conditions of Use will continue to apply until terminated by either You or us as follows.
You may deactivate Your account and discontinue to use the Community at any time by writing to our administrator at firstname.lastname@example.org.
If You breach these Conditions of Use then we may terminate Your access to the Community immediately without notice.
To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to the Community or any content on it, whether express or implied.
We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
· use of, or inability to use, the Community; or
· use of or reliance on any content displayed on the Community.
We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to Your use of the Community or to Your downloading of any content on it, or on any website linked to it.
We assume no responsibility for the content of websites linked on our site. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from Your use of them.
All pages, screens, information and other materials that we use for The Community (the “Materials”) either belong to us or our licensors. Your right to use the Materials is personal to you and you are not allowed to give this right to another person or to sell, gift or transfer your membership to another person. You may temporarily copy, download, or store extracts of the Materials to allow you to take part in the Community, but you must not alter any Materials. Your right to use the Materials does not prevent us from giving such Materials to any other person.
We have the right to transfer any and all rights under these Conditions of Use to a third party.
If any part of these Conditions of Use cannot be enforced then the remainder of the Conditions of Use will still apply. If you do not comply with these Conditions of Use and we do not take action immediately, this does not mean that we have given up any right to take action in the future.
English law will apply to all disputes and the interpretation of these Conditions of Use. The English courts will have non-exclusive jurisdiction over any dispute arising from or related to these Conditions of Use.
